These Terms of Service ("Terms") govern your access to and use of PigeonBase (the "Service"), a platform for finding lost and found pigeons and trading pigeons, provided by PigeonBase ("we," "our," or "us").

1. Acceptance of Terms

By creating an account, accessing, or using PigeonBase, you agree to:

• Comply with these Terms of Service
• Comply with our Privacy Policy
• Comply with all applicable local, national, and international laws
• Be at least 13 years old (or 16 in the EU)

If you do not agree to these Terms, you must not use PigeonBase.

2. Eligibility

To use PigeonBase, you must:

• Be at least 13 years old (16 in the EU)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Not have been previously banned from PigeonBase
• Provide accurate and truthful information during registration

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account by providing:

• Valid email address
• Full name
• Secure password
• Country and city of residence

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Not sharing your account with others

3.3 Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use PigeonBase to:

• Report lost or found pigeons
• List pigeons for sale
• Search for and purchase pigeons
• Communicate with other users about pigeons
• Post wanted ads for specific pigeons
• Review sellers and provide feedback

4.2 Prohibited Conduct

You must NOT:

• Post False Information: Submit fake reports, fraudulent listings, or misleading content
• Harassment: Harass, bully, threaten, or intimidate other users
• Spam: Send unsolicited messages, promotional content, or spam
• Illegal Activity: Use the Service for any illegal purpose, including selling stolen pigeons
• Impersonation: Impersonate another person or entity
• Inappropriate Content: Post obscene, offensive, hateful, or sexually explicit content
• Animal Cruelty: Promote or engage in animal abuse or cruelty
• Intellectual Property Violation: Post content that infringes on others' copyrights, trademarks, or other rights
• System Abuse: Attempt to hack, interfere with, or disrupt the Service
• Scraping: Use automated tools to collect data from PigeonBase
• Multiple Accounts: Create multiple accounts to evade bans or manipulate the system
• Price Manipulation: Artificially inflate prices or engage in bid manipulation
• Off-Platform Transactions: Attempt to move transactions off PigeonBase to avoid fees (if applicable)

5. User Content and Intellectual Property

5.1 Your Content

You retain ownership of the content you post on PigeonBase (photos, videos, audio, text, etc.). However, by posting content, you grant us:

• A worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your content
• The right to use your content for promotional and marketing purposes
• The right to sublicense your content to third-party service providers

5.2 Content Standards

All content you post must:

• Be accurate and truthful
• Not infringe on any third-party rights
• Comply with our Community Guidelines
• Not contain malware, viruses, or harmful code

5.3 Content Moderation

We reserve the right to remove, edit, or refuse to post any content that violates these Terms or is otherwise objectionable. However, we are not obligated to monitor all content.

6. Marketplace Transactions

6.1 Role of PigeonBase

PigeonBase is a platform that connects buyers and sellers. We do not:

• Own, sell, or deliver pigeons
• Guarantee the quality, safety, or legality of any pigeon listed
• Act as an agent or representative of any user
• Control or verify the identity of users
• Process payments (transactions occur directly between users)

6.2 Buyer Responsibilities

As a buyer, you are responsible for:

• Verifying the authenticity and quality of pigeons before purchase
• Complying with all import/export regulations and permits
• Arranging payment directly with the seller
• Resolving disputes with the seller in good faith

6.3 Seller Responsibilities

As a seller, you are responsible for:

• Providing accurate descriptions and photos of pigeons
• Ensuring you have legal ownership and right to sell
• Complying with all applicable animal welfare laws
• Fulfilling orders in a timely manner
• Providing necessary health certificates and documentation

6.4 Disputes

PigeonBase does not mediate disputes between buyers and sellers. You are encouraged to resolve disputes directly. However, we may suspend or ban users who engage in fraudulent behavior.

7. Lost and Found Pigeon Reports

When you report a lost or found pigeon:

• Accuracy: You must provide truthful and accurate information
• Ownership: For lost pigeons, you must be the owner or have authorization
• Found Pigeons: You must make reasonable efforts to locate the owner
• No Guarantee: We do not guarantee that you will find or recover your pigeon
• Rewards: Any rewards offered are your sole responsibility

8. Disclaimers and Limitations of Liability

8.1 "As Is" Service

PigeonBase is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIGEONBASE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from transactions between users
• Damages caused by user-generated content
• Unauthorized access to your account
• Service interruptions or technical failures

Our total liability for any claim shall not exceed $100 USD or the amount you paid to use PigeonBase in the past 12 months, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless PigeonBase, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post on PigeonBase
• Transactions with other users

10. Termination

10.1 By You

You may terminate your account at any time by using the "Delete Account" feature in your profile settings.

10.2 By Us

We may suspend or terminate your account, without notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse or harass other users
• Create multiple accounts to evade bans
• Pose a security or legal risk

10.3 Effect of Termination

Upon termination, your right to use PigeonBase immediately ceases. All provisions that should survive termination (including intellectual property rights, disclaimers, and limitations of liability) shall remain in effect.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [YOUR JURISDICTION], without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of PigeonBase shall be resolved through:

• Severability: If any provision is found to be unenforceable, the remaining provisions shall remain in effect
• Waiver: Our failure to enforce any right or provision does not constitute a waiver
• Assignment: You may not transfer your rights under these Terms. We may assign our rights without restriction
